1. Acceptance of Terms

By accessing or using the website at rdd-labs.com (the "Site") or any related service operated by Daniel Simonov (Osek Patur: 323812388), trading as RDD Labs, based in Israel, you agree to be bound by these Terms of Service ("Terms").

If you do not agree with any part of these Terms, please stop using the Site immediately.

We may update these Terms at any time. Continued use of the Site after an update constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page will always reflect the most recent version.

2. Description of Services

RDD Labs operates the Site to:

• Provide information about our mobile game studio and our products.
• Promote and support our debut mobile game, Color Drain (in final testing ahead of launch).
• Accept email sign-ups for launch notifications.
• Host a player community at /community, where members talk to the studio and to each other.

The Color Drain mobile game ("Game"), when released, will be governed by additional in-app terms of service presented at the time of download or first launch. Those terms may differ from these Terms.

We reserve the right to modify, suspend, or discontinue any part of the Site or our services at any time without notice or liability.

3. Eligibility

You must be at least 18 years old to submit personal information to us (including your email address). Under Israel's Legal Capacity and Guardianship Law, 5722-1962, a person under 18 is a minor. By submitting a form on the Site, you represent that you meet this age requirement. The one exception is the player community, which is open from 16 (section 15).

If you are under 18, you are welcome to read the Site, but please do not submit any personal information outside the community. If we become aware that someone under the applicable age has provided us with personal data, we will delete it promptly.

4. Acceptable Use

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You specifically agree not to:

• Scrape, crawl, or systematically extract content from the Site without our express written permission.
• Use the Site to distribute malware, spam, or other harmful content.
• Attempt to gain unauthorised access to any part of the Site or its infrastructure.
• Impersonate RDD Labs, our team members, or any other person or entity.
• Use the Site in any way that could damage, disable, or impair our servers or network.
• Reverse engineer, decompile, or disassemble any software or code associated with the Site or our games, except where permitted by applicable law.
• Submit false, misleading, or fraudulent information, including fake email addresses in our sign-up forms.

We reserve the right to block or restrict access to any user who violates these rules.

5. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, game assets, animations, code, and design — is the exclusive property of RDD Labs or its licensors and is protected under applicable intellectual property laws.

You may:

• View and share links to the Site for personal, non-commercial purposes.
• Take and share screenshots of the Site or our games for news coverage, reviews, or fan content, provided you credit RDD Labs.

You may not:

• Copy, reproduce, modify, or distribute our content without prior written consent.
• Use our brand name, logo, or game assets in a way that implies endorsement or affiliation without our permission.
• Create derivative works based on our games or Site content without authorisation.

6. User-Submitted Content

If you submit feedback, bug reports, feature suggestions, or other content to us (by email or through any future feedback channels), you grant RDD Labs a royalty-free, perpetual, irrevocable, non-exclusive licence to use, adapt, and incorporate that feedback into our products and services without any obligation to compensate you or credit you.

You retain ownership of any content you submit, but by submitting it you confirm that you have the right to grant the above licence and that the content does not infringe any third party's rights.

7. Email Communications

Email sign-up is based on your active, confirmed opt-in — by submitting our sign-up form you ask to receive communications from RDD Labs, and by opening the link in the confirmation email we send you, you confirm that the address is yours. Nothing further is sent until you do, and we do not add anyone to our list without that deliberate two-step action.

Some emails we send constitute advertising material under Section 30A of the Israeli Communications Law (Bezeq and Broadcasts), 5742-1982. Every such email is marked פרסומת in its subject and body, clearly identifies RDD Labs as the sender with our contact details and address, and includes a one-click unsubscribe link. You may opt out at any time, without conditions, by clicking that link, using your mail app's own unsubscribe button, replying to the message, or emailing support@rdd-labs.com. We honour all opt-out requests immediately and will not send further advertising material to anyone who has unsubscribed.

8. Third-Party Links

The Site may contain links to third-party websites (for example, app stores, development tools, or social media). These links are provided for convenience only. RDD Labs has no control over, and accepts no responsibility for, the content, privacy practices, or terms of any third-party website. Visiting a linked site is at your own risk.

9. Disclaimer of Warranties

The Site and all content and services provided through it are offered on an "as is" and "as available" basis, without warranties of any kind — express, implied, or statutory.

RDD Labs makes no warranty that:

• The Site will be uninterrupted, error-free, or secure.
• Any information on the Site is accurate, complete, or up to date.
• The Game will launch on any particular date or with any particular features.
• The Site is free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, RDD Labs and its members, employees, and contractors shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from your use of, or inability to use, the Site or our services.
• Damages resulting from unauthorised access to or alteration of your data.

In any event, our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the total amount you actually paid to us in connection with the service giving rise to the claim. Because the Site is currently free of charge, this amount is ILS 0 unless a specific paid service has been provided to you.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. To the extent such restrictions apply to you, some of the above limitations may not apply.

11. Indemnification

You agree to indemnify and hold harmless RDD Labs and its members, employees, and contractors from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-law provisions.

Any dispute arising from or relating to these Terms or your use of the Site shall be brought before the competent courts in Ashdod, Israel (Southern District of Israel). Nothing in this clause limits any mandatory right you may have under Israeli consumer protection law to seek relief in a court otherwise competent to hear your claim.

Before initiating any legal action, we encourage you to contact us at support@rdd-labs.com to attempt to resolve the dispute informally. We're a small studio and always prefer a conversation first.

13. General Provisions

• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force.
• Waiver: Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
• Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy — and, for community members, the community rules — constitute the entire agreement between you and RDD Labs regarding your use of the Site.
• Language: These Terms are written in English. In case of any translation, the English version takes precedence.

14. Accessibility

RDD Labs is operated by Daniel Simonov (Osek Patur: 323812388) as a sole proprietor (Osek Patur) under Israeli law. Under the Israeli Equal Rights for Persons with Disabilities Law, 5758-1998 and the Service Accessibility Regulations (5773-2013), businesses operating as Osek Patur are exempt from the mandatory website-accessibility requirements. Accordingly this Site is not certified as compliant with Israeli Standard (IS) 5568 / WCAG 2.0 AA.

Notwithstanding this exemption, we publish an Accessibility Statement voluntarily. It records the standard we work to, what is in place, the known limitations with the dates we expect to fix them, and how to reach us — and we make reasonable, good-faith efforts to keep the Site navigable and usable for as many visitors as possible, including those who rely on assistive technologies such as screen readers or keyboard navigation.

If you encounter an accessibility barrier on the Site — such as content that is difficult to read, navigate, or use with your assistive technology — please contact us at support@rdd-labs.com. We will do our best to respond in a reasonable time and, where possible, provide the information you need in an alternative format.

15. The Player Community

If you join the player community, the community rules are part of these Terms for you. You accept them the first time you sign in, and they can change the way section 1 describes.

What you post stays yours. By posting it you grant RDD Labs a non-exclusive, royalty-free licence to show it on the Site for as long as it is up — including as “deleted member” after you delete your account, as the Privacy Policy explains.

We may hide or lock posts and suspend accounts when the rules are broken, and we say why. Every decision can be appealed at /community/appeal; anything can be reported at /community/report.

The community is for people aged 16 and over. If you are under 16, do not join.
